The Civil Litigation Process

Here are the steps involved in the New Jersey civil litigation process:

Filing the Lawsuit: A civil action starts when one party files a complaint in court and pays a filing fee required by state statute. The summons will be issued by the court and served to the defendant.

Answer: The defendant will have up to 35 days to file an answer or ask the court to dismiss the case through a written motion. The defendant may be required to assert or respond to any counterclaims against the plaintiff or cross-claims against other defendants.

Discovery: Each party can request for discovery of the information and evidence available to the other party. The discovery process may include oral depositions, written interrogations, subpoenas, requests for written admissions, and document inspection. Oftentimes, the discovery phase is where the case is won or lost.

Pre-Trial: At the pre-trial conference, the judge will make rulings on motions and decide the type of evidence that can be admitted. The case may either be resolved during the pre-trial conference or a date may be set for trial.

Trial: The trial begins with the opening statements, followed by the presentation of evidence and witness testimonies in court, then by closing statements to the judge. If it is a jury trial, the jury will deliberate and reach a verdict. The judge's decision or jury's verdict will be read in open court.

Judgment Enforcement: If the judgment is for a sum of money, the prevailing party may take necessary legal steps to enforce the judgment and recover the award.

Appeal: However, when a civil litigation case ends with an unfavorable or unsatisfactory result, the aggrieved party may file an appeal to get the judgment reviewed, modified, or ultimately overturned. You have up to 45 days from the date the judgment was issued to file an appeal.

Civil litigation matters in New Jersey often involve many complex procedures and are fiercely contested. Whether you are being sued or are thinking of filing a lawsuit against another party, we can craft an effective legal strategy for your unique situation and guide you through every step of the legal process.
